How online pickup works
Step 1: you order or reserve online. Accessories may be paid for online. Tobacco, vapor and nicotine products can only be reserved, and no payment is taken online for them. Step 2: we prepare your items and tell you when they are ready. Step 3: you come to the store in person with your order code. Step 4: we check your government photo ID; reserved items are paid for at the counter and the sale is completed there. The numbered terms below are the rules that apply to every order and reservation.
1. Who may use this site
This site is operated by Smoke Vibez, 800 Trinity Dr STE A, Los Alamos, NM 87544 ("we", "us", "the store"). You may use it only if you are 21 years of age or older. By entering the site, reserving or ordering, you confirm that you are 21 or older and that you agree to these Terms of Use. If you do not agree, do not use the site.
2. Pickup only. No shipping or delivery
Everything on this site is for in-person pickup at our store. We do not ship or deliver any product, and we do not arrange for anyone else to do so.
3. Tobacco and vapor products are reserved online and sold in store
Tobacco products, e-cigarettes, vapor products, nicotine products and any other item marked "Pay in store" cannot be bought on this site. For those items the site only takes a reservation request. No payment is taken online, no sale is made online, and a reservation is not an offer to sell or a contract of sale. The sale takes place only at our counter, face to face, after we check your identification and accept payment. Any order that contains a "Pay in store" item is treated entirely as a reservation.
4. Identification at pickup
You must collect your items yourself and show a valid, unexpired government-issued photo ID proving you are 21 or older. The name on the ID must match the name on the order or reservation. We may scan or otherwise verify the ID. If you cannot show acceptable ID, or we have any doubt about your age or identity, we will refuse to hand over the items. Nobody else may collect on your behalf.
5. No purchases for minors or for resale
You agree not to buy, collect or obtain any product for, or give or sell any product to, anyone under 21. Products are for your own lawful personal use and not for resale.
6. Our right to refuse or cancel
We may refuse, limit or cancel any order or reservation at any time and for any lawful reason, including suspected underage purchase, suspected resale, quantity limits, pricing or stock errors, or suspected fraud. If we cancel an order you paid for online, we refund the amount paid to the original payment method.
7. Reservations and holds
Reserved items are held for a limited time shown on your confirmation. If you do not collect and pay within that time the reservation ends and the items go back on sale. Totals shown for reservations are estimates; the price and tax charged at the counter at the time of sale apply.
8. Prices, stock and product information
Stock shown comes from our store system and can change before you arrive. We try to keep prices, descriptions and photos accurate but do not guarantee it. If an item is unavailable when you arrive, your remedy is a refund of anything you paid online for that item.
9. Online payments and refunds
Items that can be paid for online are charged when you place the order. Returns and refunds follow the store policy posted in store. Opened or used products generally cannot be returned unless defective.
10. Health warnings and lawful use
Tobacco and nicotine products are addictive and harmful to health. WARNING: Vapor products contain nicotine. Nicotine is an addictive chemical. No product on this site is sold as a way to stop smoking or as safer than any other product. Nothing on this site is medical advice. All products are sold for lawful use only, and you are responsible for knowing and following the laws that apply to you.
11. Disclaimer and limit of liability
The site and the products are provided "as is" to the fullest extent the law allows. To the fullest extent the law allows, Smoke Vibez, its owners and its employees are not liable for indirect, incidental, special or consequential losses, or for any harm arising from the use or misuse of any product, and our total liability for any claim relating to an order is limited to the amount you paid us for that order. Nothing here limits rights that cannot be limited by law.
12. Your responsibility to us
You agree to indemnify and hold harmless Smoke Vibez, its owners and its employees against claims, losses and costs (including reasonable attorney fees) arising from your breach of these terms, false statements about your age or identity, or your unlawful use or transfer of any product.
13. Your information
We collect your name, phone, email, order details and the time and internet address from which you accepted these terms. We use it to prepare your order, contact you about it, prevent underage sales and fraud, and keep records the law requires. Card details are entered directly with our payment processor and are not stored on this site.
14. Governing law
These terms are governed by the laws of the State of New Mexico and applicable federal law. Any dispute will be heard in the state or federal courts located in New Mexico.
15. Changes
We may update these terms. The version in effect when you place an order or reservation applies to it. You will be asked to accept any new version before using the site again.
